1. Acceptance of Terms

By downloading, installing, or using the Fair Friend mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Keith Andrews ("Developer," "we," "us," or "our"), the sole developer and operator of Fair Friend.

These Terms apply to all users of the App, including customers who browse fair and festival listings ("Customers") and vendors who create business profiles and listings ("Vendors").

2. Description of Service

Fair Friend is a mobile marketplace platform that connects fair and festival Vendors with Customers attending fairs, festivals, and similar events. The App allows:

The App does not process transactions between Customers and Vendors. All purchases of goods or services are made directly at the vendor's physical booth.

3. Eligibility

You must be at least 18 years of age to create a Vendor account. By registering, you represent and warrant that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business entity.

4. Vendor Accounts

4.1 Account Registration

Vendors must register for an account to access listing and event application features. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@fairfriend.app if you suspect unauthorized access to your account.

4.3 Transactional Email Communications

By registering for a Vendor account, you consent to receiving transactional emails related to your account and activity on the App. These may include account approval or rejection notices, business profile and photo review decisions, event application status updates, and other operational communications necessary to provide the service. These emails are not marketing communications and are required for the operation of your account. They are delivered via our email service provider, Resend, using the email address you provide at registration.

4.4 Account Approval

Vendor accounts are subject to review and approval by the Developer or Event Administrators. We reserve the right to approve, decline, suspend, or terminate any account at our sole discretion, without notice or liability.

Vendors whose accounts have been declined, suspended, or terminated may not re-register or reapply to any event without express written permission from the Developer. The Developer's decisions regarding account status are final and are not subject to appeal.

5. Vendor Listings and Content

5.1 Accuracy of Listings

Vendors are solely responsible for the accuracy, completeness, and legality of all content submitted through the App, including but not limited to business name, description, photos, menu items, and pricing. The Developer makes no representations or warranties regarding the accuracy of Vendor-submitted content.

5.2 Pricing Disclaimer

PRICES DISPLAYED WITHIN THE APP ARE SET SOLELY BY VENDORS. THE DEVELOPER DOES NOT SET, VERIFY, GUARANTEE, OR CONTROL ANY PRICING INFORMATION. FAIR FRIEND IS NOT RESPONSIBLE FOR ANY DISCREPANCY BETWEEN PRICES DISPLAYED IN THE APP AND PRICES CHARGED AT A VENDOR'S PHYSICAL BOOTH. CUSTOMERS ARE ADVISED TO CONFIRM PRICING DIRECTLY WITH THE VENDOR AT THE TIME OF PURCHASE.

5.3 Photo and Content Standards

All photos and content submitted must accurately represent the Vendor's actual products or services. The Developer reserves the right to reject or remove any content that, in our sole judgment, is inaccurate, misleading, offensive, or otherwise in violation of these Terms. Vendors may receive written rejection reasons for non-compliant submissions.

5.4 Item Listing Review and Approval

All item listings are subject to review and approval by the relevant Event Administrator or Super Administrator before they appear publicly in the App. Vendors may update existing listings at any time, however any changes will require re-review and re-approval before the updated information is visible to Customers. The Developer is not responsible for delays in the review process or for item information that has not yet been approved and published.

6. Location and Navigation Features

6.1 Location Data

The App may request access to your device's location to provide navigation and proximity features. Location access is optional. By enabling location services, you consent to the collection and use of your device's location data as described in our Privacy Policy.

6.2 Location Accuracy Disclaimer

VENDOR BOOTH LOCATIONS AND MAP COORDINATES DISPLAYED IN THE APP ARE PROVIDED FOR GENERAL GUIDANCE ONLY. BOOTH LOCATIONS ARE MANUALLY ENTERED BY VENDORS OR EVENT ADMINISTRATORS AND MAY NOT PRECISELY REFLECT ACTUAL PHYSICAL PLACEMENT AT AN EVENT. THE DEVELOPER DOES NOT GUARANTEE THE ACCURACY OF ANY LOCATION DATA AND IS NOT RESPONSIBLE FOR NAVIGATION ERRORS, MISSED DESTINATIONS, OR ANY CONSEQUENCES ARISING FROM RELIANCE ON IN-APP LOCATION INFORMATION.

6.3 Third-Party Mapping

Mapping functionality is provided by Mapbox, a third-party service. The Developer is not responsible for the accuracy, availability, or functionality of Mapbox services. Use of mapping features is subject to Mapbox's own terms of service.

7. Premium and Featured Spot Features

7.1 Premium Listings

Vendors may request a Premium listing upgrade, which provides enhanced visibility within the App. Premium upgrade requests are submitted via in-app contact form and are subject to review and approval by the relevant Event Administrator or Developer. The Developer reserves the right to approve or deny any upgrade request at its sole discretion.

7.2 Featured Spots

Vendors may request a Featured Spot for increased prominence during an event. Featured Spot requests are handled off-platform. Availability and pricing are determined solely by the Event Administrator or Developer and communicated directly to the requesting Vendor. The Developer makes no guarantee of Featured Spot availability.

7.3 No Refunds

All fees paid for Premium upgrades or Featured Spots are non-refundable unless otherwise agreed in writing by the Developer. The App does not process in-app payments; all payment arrangements are made directly between the Vendor and the Event Administrator or Developer.

9. Intellectual Property

The App and all content, features, and functionality provided by the Developer — including but not limited to the Fair Friend name, logo, design, code, and text — are the exclusive property of Keith Andrews and are protected by applicable intellectual property laws.

Vendors grant the Developer a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute any content submitted to the App solely for the purpose of operating and promoting the App and its features.

10. Third-Party Services

The App integrates with third-party services including Supabase (database and authentication), Mapbox (mapping), Resend (email delivery), and Expo (mobile platform). The Developer is not responsible for the performance, availability, or data practices of any third-party service. Your use of third-party services through the App may be subject to those services' own terms and privacy policies.

11. Disclaimers of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT; WARRANTIES THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE; AND WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT IN THE APP, INCLUDING VENDOR LISTINGS, PRICING, PHOTOS, OR LOCATION DATA.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, ANY CONTENT OR INFORMATION OBTAINED THROUGH THE APP, OR ANY TRANSACTION BETWEEN CUSTOMERS AND VENDORS. THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED FIFTY U.S. DOLLARS ($50.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Keith Andrews and any affiliated parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) any content you submit to the App; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any dispute between you and another user of the App.

14. Modifications to the App and Terms

The Developer reserves the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without liability to you. We also reserve the right to update these Terms at any time. Updated Terms will be effective upon posting within the App or on our website. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Cumberland County, Maine.

16. App Store Terms

This App is distributed through the Apple App Store and Google Play Store. You acknowledge that these Terms are between you and the Developer only, and not with Apple Inc. or Google LLC. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance. Apple and Google have no obligation to provide maintenance or support for the App and are not responsible for the App or its content.
